After two hung juries, the Wayne County Prosecutor’s Office has decided not to retry the police officer who killed Aiyana Stanley-Jones in a raid gone horribly wrong four years ago.
Joseph Weekley, 38, faced a misdemeanor charge of careless discharge of a firearm causing death after a bullet from his gun struck the girl during a raid of a home in search for a murder suspect in May 2010.
Wayne County Judge Cynthia Gray Hathaway dismissed a felony charge of involuntary manslaughter against Weekley during his second trial last year, citing a lack of evidence.
Detroit police had been searching for a suspect in the fatal shooting of a teenager when they raided the building where Jones was sleeping. The suspect was apprehended in the building and later sentenced to life in prison.
Jones was struck in the head by a bullet during the raid, and prosecutors argued that Weekley had been willfully negligent. An attorney for the officer said the gun discharged when Jones’ grandmother grabbed it.
